Terms of Service
Last updated: May 23, 2026
These terms govern your use of Busy Skipper Bot, operated by Busy Skipper Bot LLC (“we,” “our”). By creating an account or using the service, you agree to these terms. If you do not agree, do not use the service.
Private preview
Busy Skipper Bot is in private preview. The service is provided free of charge, on an as-is, as-available basis. Features may change, break, or be removed without notice. We may pause or discontinue the service at any time. This is not a production service and is not appropriate for use cases where uptime, accuracy, or message delivery must be guaranteed.
Who can use the service
- You must be at least 18 years old and able to enter a binding agreement.
- You must be a sailboat skipper (or directly authorized to manage a skipper's crew) using the service to coordinate your own boat's crew for racing.
- You must connect a Google account you control and authorize us to act on its behalf for the limited scopes described in the Privacy Policy.
Your responsibilities
Account security
You are responsible for safeguarding your Google account and any credentials used to access the service. Activity that occurs through your account is your responsibility. Notify us at support@mail.busyskipper.bot if you suspect unauthorized access.
Crew you add
You may only add a crew member's contact information (email or phone number) if you have a genuine personal or sailing relationship with them and a reasonable basis to believe they welcome the contact. You represent and warrant, each time you add a crew member, that you have the authority to do so.
When a crew member texts the bot to opt in, the bot replies with a one-time disclosure SMS asking them to confirm (reply YES) before any scheduling messages are sent; the bot does not text a crew member who has not contacted it first. You may not work around this consent step. You may not use the service to contact people you do not personally know, to send promotional messages, or to send any message unrelated to crew scheduling for your boat.
Compliance with law
You are responsible for complying with all applicable laws and carrier rules in your jurisdiction relating to your use of the service, including communications, privacy, and consumer protection laws.
Acceptable use
You agree not to:
- Use the service for marketing, promotional, political, fundraising, or any non-scheduling messaging.
- Add a phone number or email address without a reasonable basis to believe the recipient welcomes the contact.
- Attempt to bypass the crew-side opt-in (SMS YES) or opt-out (STOP) mechanisms.
- Use the service to harass, defraud, or harm another person.
- Probe, scan, scrape, or test the vulnerability of the service or its infrastructure; access the service through automated means other than the intended interfaces; or attempt to reverse engineer the service.
- Resell, sublicense, or commercialize the service or any part of it.
Your content; license to operate
You retain ownership of the data and content you provide to the service (including your crew roster, race events, and inbound or outbound messages routed through the bot). You grant us a non-exclusive, worldwide, royalty-free license to process this content solely for the purpose of providing and operating the service to you, including transmitting it to the sub-processors listed in the Privacy Policy.
Service availability
There is no service-level agreement. The service may be unavailable due to maintenance, third-party outages (including Google or our third-party hosting, SMS, email, and AI providers), development changes, or for any other reason. Time-sensitive communications should be confirmed by another channel.
Termination
You may stop using the service and request account deletion at any time by emailing us. We may suspend or terminate your access at any time, with or without notice, if we believe you have violated these terms or that continued access creates risk to other users, our partners, or the service. On termination, we will purge your account data per the retention rules in the Privacy Policy.
No warranties
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR THAT MESSAGES WILL BE DELIVERED, PARSED CORRECTLY, OR ROUTED ON TIME. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.
Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW, BUSY SKIPPER BOT LLC AND ITS OWNERS, OFFICERS, AND CONTRACTORS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING FROM OR RELATED TO YOUR USE OF THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS (USD $100).
Indemnification
You agree to indemnify and hold harmless Busy Skipper Bot LLC and its owners, officers, and contractors from any claim, loss, or expense (including reasonable attorney fees) arising from your use of the service, your content, your breach of these terms, or your violation of any law or third-party right — including any claim by a crew member you added without an appropriate basis.
Changes to these terms
We may update these terms as the service evolves. The “Last updated” date at the top reflects the most recent change. Material changes will be communicated to active skippers by email. Your continued use of the service after a change constitutes acceptance of the updated terms.
Governing law
These terms are governed by the laws of the State of Washington, without regard to its conflict-of-laws principles. Any dispute arising from these terms or your use of the service will be brought exclusively in the state or federal courts located in Washington, and you consent to the personal jurisdiction of those courts.
